Definition of responsible operator within the EU

The manufacturer, authorised representative, importer, distributor, fulfilment service provider or other natural or legal persons who are subject to obligations in respect of the manufacture of products, their making available on the market or their putting into service in accordance with the applicable Union harmonization legislation (Article 3 point 13 Regulation EU 2019/1020).

The European Union’s goal is to create a single market in which goods, services, capital and people can move freely between member states. This requires not only removing barriers to trade, but also harmonizing laws and regulations to ensure that products approved in one member state can be traded throughout the Union. An important pillar of these harmonization efforts is Regulation (EU) 2019/1020 on market surveillance and conformity of products.

What is Regulation (EU) 2019/1020?

Regulation (EU) 2019/1020, which entered into force on July 16, 2021, aims to improve market surveillance of products placed on the EU market to ensure that all products comply with European health, safety and environmental standards. It sets requirements for the role of market surveillance authorities and imposes obligations on economic operators (manufacturers, importers and distributors) who ensure that only compliant products are placed on the market.

Article 3, point 13: Harmonization of EU legislation

Article 3(13) of Regulation 2019/1020 defines “Union harmonization legislation” as “harmonization of Union legislation relating to products placed on the internal market.” This means that all member states must ensure compliance with uniform safety and performance requirements when products are introduced and sold. This ensures that products meeting these requirements can be marketed throughout the EU without further technical barriers.

The purpose of this harmonization legislation is to eliminate differences between national rules that may distort trade within the internal market. Harmonization ensures that products meet the same requirements in all member states, which not only protects the safety and health of consumers, but also ensures fair competition and encourages innovation.

Importance of Harmonization for Businesses and Consumers

For companies, the harmonization of legislation means that they do not have to make separate certifications or adjustments to their products for each member state. This reduces costs and facilitates access to the entire European market, which is especially important for small and medium-sized enterprises (SMEs). SMEs have a greater opportunity through harmonization legislation to sell their products in multiple member states without additional costs or barriers, which stimulates economic growth.

For consumers, the harmonization of EU legislation provides additional protection. They can be confident that products sold in the EU market meet high quality standards regardless of their country of origin within the Union. This applies to a variety of product categories, from electrical appliances and toys to medical devices and chemicals.

Market Surveillance and the Role of Member States.

However, harmonization legislation would not be effective without adequate supervision. Regulation (EU) 2019/1020 has created an important framework for market surveillance within the EU. Market surveillance authorities in each member state have the responsibility to check products and ensure that they meet the requirements set. The regulation also laid the groundwork for closer cooperation between member states and the European Commission, especially in the detection and disposal of unsafe products.
